
Tiffany and Co. continues to await the verdict in a recent lawsuit filed against eBay for copyright infringement. The well-known jewelry retailer has requested that eBay not allow counterfeit reproductions of its trademark silver jewelry to be sold on the auction site.
eBay's position on the matter: They simply cannot police counterfeit items as they do not take ownership of the items sold on the site. Furthermore, eBay claims that they do not have the knowledge or expertise to identify counterfeit items and distinguish the reproductions from the originals. The burden of proof lies with Tiffany's, not with eBay.
